Disturbing the Peace

At the law firm of Dudley Goar, Attorney at Law, we offer experienced legal representation for individuals charged with ‘Disturbing the Peace’ under Massachusetts General Laws (G.L.) c. 272, §53. We aim to protect your rights and build a strong, personalized defense for your specific case.

To convict someone of Disturbing the Peace, the prosecution must prove beyond a reasonable doubt that

  • That the defendant engaged in conduct which most people would find to be unreasonably disruptive, such as fighting, violent, or tumultuous behavior, or creating a noisome and offensive condition.
  • That the defendant’s actions were done intentionally, and not by accident or mistake; and
  • The defendant’s actions did in fact annoy or disturb at least one member of the public.

Sentencing

Upon conviction, ‘Disturbing the Peace’ under G.L. c. 272, §53 may result in a fine of up to $150 or imprisonment in a house of correction for up to six months, or both. The severity of the sentence can depend on factors such as prior offenses, the nature of the conduct, and whether there was an intent to cause public disruption.

Possible Defenses

Defenses against a charge of ‘Disturbing the Peace’ may include:

  • Insufficient Evidence: The defendant can challenge the evidence, arguing it fails to meet the legal requirements for disturbing the peace.
  • First Amendment Protection: Speech is protected, unless it incites violence or poses a clear danger.
  • Lack of Intent: The defendant might argue they had no intent to do something which would cause public disruption or recklessly risk such harm.

To amount to disturbing the peace, the defendant’s acts must have been voluntary, unnecessary, and contrary to normal standards of conduct.

Y.J.

Attorney Goar defended me in a criminal case in which I had been falsely accused of a crime by my business competitors. He was successful in getting the criminal case dismissed and then represented me in a civil case against the people who had falsely accused me. Thanks to Attorney Goar I cleared...
