Obtaining a restraining order, also called an Abuse Prevention Order, is a civil matter governed by Mass. General Laws Chapter 209A. Someone may obtain a restraining order against “family or household members” if they demonstrate to the judge that they have suffered “abuse” from that person.
A judge can tailor an Abuse Prevention Order to require the respondent (the person against whom the order is obtained) to refrain from a) abusing the complainant (the person who obtains the order); b) contacting the complainant; c) staying away from the complainant; or d) vacating the same household or workplace as the complainant. The judge also has authority to enter orders regarding the protection of minor children.
